The scope of ICC jurisdiction in the implementation of political-legal extradition

Abstract:

The article discusses the legal foundations of extradition, including international treaties and national legislation. The focus is on the politicization of extradition, on how governments can use extradition as a tool for political maneuvering, influencing international relations and domestic politics. The aim of the study is to conduct a political-legal analysis of extradition in the field of international criminal law, to clearly present the problems and find solutions. It discusses the intersection points of extradition and diplomacy, emphasizing how extradition cases often go beyond the legal framework. The emphasis is on the importance of the existence of international treaties, the fulfillment of the requirements stipulated by law. The positive and negative consequences that the active involvement of the state in making decisions on extradition are discussed.

The paper draws conclusions and lists certain recommendations that may help us further view extradition in a broader perspective and see the importance of the legal part in it, so that the State and the law can jointly resolve the issue of extradition of a person while respecting the rule of law.
