Sequestration as a coercive enforcement measure

Abstract:

The present article discusses the grounds and procedures for forced property management (sequestration), focusing on the norms outlined in the Law of Georgia “On Enforcement Proceedings.” The author presents practical problems and the ways to solve them. This article, closely examines foreclosure measures, providing insights into the legal aspects, particularly the role and significance of sequestration in legislation. Despite its status as a benign alternative to auctions, sequestration remains underutilized in administration. Through comparative analysis with international legislation and practices, the study aims to offer a comprehensive legal analysis of forced property management. By doing so, it sheds light on the importance of sequestration as an institution within Georgian law.
